A admissibilidade de 'prova pirateada' em arbitragem internacional

Uma consideração emergente na arbitragem internacional é a utilização de provas adquiridas de forma ilegal. As provas obtidas ilegalmente podem assumir diversas formas, incluindo, por exemplo, registos ilícitos, informações obtidas por ”leaks”, e "provas pirateadas". A 'prova pirateada' refere-se a materiais obtidos através do acesso não autorizado a um sistema eletrónico (diretamente ou através de terceiros), e normalmente inclui correio eletrónico, documentos digitais, gravações áudio e vídeo armazenadas eletronicamente, mensagens e registos instantâneos, ou registos de transações financeiras.

O Kluwer Arbitration Blog publicou um artigo que analisa a admissibilidade de provas obtidas ilegalmente na arbitragem internacional, analisando diferentes regras de arbitragem e decisões de tribunais arbitrais. As regras de arbitragem dão ampla margem aos tribunais para determinar a admissibilidade de provas obtidas ilegalmente (e questões de prova de forma mais geral). Normalmente, isto envolve a realização de um exercício de equilíbrio que considera (1) o processo e as circunstâncias através das quais o material foi obtido (e a sua compatibilidade com obrigações de boa-fé, justiça processual e igualdade das partes); e (2) o valor probatório da própria prova (incluindo considerações de confidencialidade e relevância).
